India’s new data-privacy bill has caught the attention of many, and is a mixed bag. Here are some key points-of-view around the same…
The concept of regulated digital-privacy protection, as expressed in India’s Digital Personal Data Protection Bill, 2022, may pose the greatest threat to individual choice, digital freedom, and privacy.
Importantly, the new bill offers a mixed bag for privacy—with some requirements for companies to receive individual “consent,” correct inaccurate personal data, and protect data rights alongside concerning provisions for government data access.
Opposition members like Mahua Moitra, criticized that the data protection bill exempted central government agencies like the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) from the bill’s purview on the rationale of protecting “national interests,” state security, and public order.
🔴 Bottomline: The current data market will soon give way to a market for privacy protection, in which freedom of choice is exchanged for security, convenience, and access. While there’s a strong case for a legal framework to prevent citizens’ personal information from being harvested and exploited by foreign corporations, the Bill remains oblivious to at least two major considerations: the freedom of the market and the autonomy of users.
